Agreements regarding the suspension of employment contracts, as well as salary reductions, which were permitted as a result of the new coronavirus pandemic through Provisional Measure 936 are extended again.

This means that contracts can now be suspended for up to eight months, meaning the rule is valid until December.
Therefore, as most agreements come to an end this month, the government will allow employers and employees to extend the agreements for another two months, but this will be subject to the signing of another contractual addendum.
As a result, many workers who have had their contracts changed do not know how their 13th salary payment will be handled.
What is the 13th salary?
The thirteenth salary is a Christmas bonus, and is therefore a type of extra salary granted to all those who work with a formal contract.
Therefore, it ensures that, for each month worked, the employee is entitled to an extra payment corresponding to 1/12 of their salary.
Therefore, the value of the thirteenth salary is the same as the employee's monthly salary if he or she has been working for at least 12 months.
Payment of the thirteenth month of suspended contracts
According to labor law, the thirteenth-month salary is calculated based on the number of months worked. Therefore, for each month worked, 1/12 of the salary will be considered.
Therefore, the months in which you are not working, with the exception of vacations, are not taken into account for this calculation.
Therefore, each month that the contract was suspended means 1/12 less in benefits.
That said, for workers with suspended contracts, the months in which the agreement is in force will not be counted towards the calculation of the 13th salary, which means a reduction of 66.7% of this benefit.
Sometimes it can happen to affect the 13th salary, in case of reduction of working hours and salary, but each case has a different situation, the 13th corresponds to the remuneration for the month of December.
If the reduction in working hours and salary occurs in a period that does not cover this month, the employee will be entitled to the full amount of the 13th salary.
