25% increase in INSS benefit

Recently, the National Social Security Institute (INSS) announced that it will increase the benefit amount by 25% for some insured individuals, such as those who retired due to disability.

The benefit in question is a caregiver allowance, designed to supplement retirement benefits by providing an amount that will help cover the daily expenses of a professional hired to care for the retiree.

Therefore, to be entitled to this benefit, the retiree must be deemed unfit to perform work activities, thus requiring a caregiver, who may be a nursing professional or even a family member who accepts this responsibility.

How do I request an increase in my INSS benefits?

It is important to note that the benefit is granted automatically along with the retirement application process.

However, those citizens who are already retired due to disability but are not yet receiving the benefit can apply for it through... MY INSS or through the Customer Service Center at 135.

Required documents

In order for the application to be completed, the INSS (Brazilian National Social Security Institute) informs that it is necessary to present some documents, among them are:

  • CPF;
  • Photo identification document of the applicant, representative, or attorney;
  • Legal representation document or power of attorney;
  • Medical reports that can prove the condition of incapacity and dependence on third parties.

Legislation

The measure is provided for in Article 45 of Law number 8.213, of 1991, which provides for the possibility of granting an additional amount of up to 25% to those retired due to disability who need care from another person to perform daily tasks.

However, according to current legislation, the INSS (Brazilian National Social Security Institute) does not accept similar requests from other categories of retirees.

"Article 45. The value of the disability pension for an insured person who requires the permanent assistance of another person shall be increased by 25% (twenty-five percent)."

Sole paragraph. The increase referred to in this article:

a) it will be due even if the retirement benefit reaches the maximum legal limit;

b) it will be recalculated when the benefit that gave rise to it is readjusted;

(c) it will cease upon the death of the retiree and will not be incorporated into the pension amount.

Diseases that allow for a 25% increase in INSS benefits

According to Annex I of Decree 3.048 of 1999, as well as Article 226, §1 of IN No. 77/2015, a person retired due to disability acquires the right to this 25% increase if they prove:

  • Loss of nine or more fingers on the hands;
  • Total blindness;
  • A disease that requires continuous bed rest;
  • Paralysis of two lower or upper limbs;
  • Loss of one hand or both feet, even though a prosthesis is a solution;
  • Loss of lower limbs, above the feet, when a prosthesis is not possible;
  • Loss of an upper or lower limb when a prosthesis is not possible;
  • Permanent disability for daily activities;
  • Severe impairment of mental faculties.
