INSS reduces lifetime review for retirees: understand the reason

However, the conditions for the review are still being defined by the Supreme Federal Court (STF).

According to the decree published at the end of November, the Supreme Federal Court It was established that the insured person's contribution will be calculated based on the value of one minimum wage.

This occurs in cases of inconsistencies in the National Social Information Registry (CNIS).

Thus, the inconsistency may be the absence of the salary amount or the contribution period, and registration errors in data prior to the beginning of the 1990s.

"This measure adopted by the INSS (Brazilian National Social Security Institute) could undermine the gains from the review, because those who are fighting for this right in court want to include in the calculation the highest contributions made before July 1994," said lawyer Rômulo Saraiva in an interview with the newspaper Agora São Paulo.

What is a lifetime review?

The lifetime review allows for the addition of salaries prior to July 1994, before the Real Plan.

However, the process of requesting a recalculation of INSS retirement benefits can only be done through legal action.

Therefore, it is not granted through an administrative request from Social Security.

Given this, it foresees the inclusion of 80% of the worker's largest contributions to INSS (Brazilian Social Security Institute) before July 1994, when the national currency became the Real.

In August, the Supreme Federal Court (STF) ordered a halt to all lifetime review proceedings.

That's because the Supreme Court still has to rule on whether the right to recalculate is constitutional, but there's no date set for the vote yet.

Furthermore, the right to a lifetime review only applies to retirees who have been receiving benefits for at least 10 years. Therefore, the deadline for reviewing INSS (Brazilian Social Security Institute) calculations is stipulated in the social security law.
